Please read these Terms carefully. They are a binding agreement between you and Swift Appliance Repair LLC. Section 23 contains an agreement to resolve disputes by individual binding arbitration and a waiver of class actions, which affect how disputes between us are resolved. You may opt out of arbitration within 30 days, as explained in Section 23.8.
The short version
- You know the diagnostic fee before the visit, and you get a written estimate before any repair. Work starts only after you approve it.
- The diagnostic fee is charged per appliance. It is credited toward the repair if you approve the repair and we perform it.
- Our labor is covered by a 90-day limited warranty. Parts are covered by their manufacturer’s or supplier’s warranty.
- We stand behind our workmanship, but we are not responsible for pre-existing conditions, food loss, or failures of plumbing, wiring, gas lines or vents we did not install (Sections 11–12).
- Service texts can be stopped at any time by replying STOP. We send promotional texts only if you separately opt in (Section 15).
- Our website content, photos, design and name are protected. Copying them has consequences (Section 18).
This summary is for convenience only. The full Terms below control.
1. Who we are and what these Terms cover
1.1 Who we are. “Swift,” “we,” “us” and “our” mean Swift Appliance Repair LLC, a North Carolina limited liability company, 5035 Tura St, Raleigh, NC 27610. “You” and “your” mean the person who uses our website or requests or receives our services, and anyone on whose behalf that person acts.
1.2 What these Terms cover. These Terms and Conditions (“Terms”) apply to:
- the website at swiftypros.com, its pages and subdomains, and any other website we operate that links to these Terms (together, the “Site”);
- all appliance diagnostic, repair, maintenance, installation and related services, and any other repair or maintenance services we provide (the “Services”), however they are booked: through the Site, our online booking page, by phone (including through our automated phone assistant), by text or email, through Google, Yelp, Thumbtack or another platform, or through a landlord, property manager, home warranty company or other third party; and
- our calls, text messages and emails with you.
1.3 How you accept these Terms. You accept these Terms when you use the Site, book or request Services, let our technician begin work, approve an estimate (including by electronic signature), or pay an invoice. If you do not agree, do not use the Site or the Services.
1.4 Other documents. Our Privacy Policy explains how we collect, use and share personal information. Each job is also governed by the estimate you approve and the invoice we issue. If an estimate or invoice you approved conflicts with these Terms on a specific point, such as the price or the scope of work, the estimate or invoice controls on that point for that job. Everything else in these Terms continues to apply.
1.5 Service areas. We serve the areas listed on the Site. Each area page shows its local phone number, prices and available services, which can differ between areas. These Terms apply in every area. If the law of the state where your property is located gives you rights that cannot be waived by contract, nothing in these Terms limits those rights.
2. Eligibility and authority
2.1 Age. You must be at least 18 years old and able to enter into a binding contract to book or approve Services.
2.2 Authority over the property. When you book Services for a property, you confirm that you own the property and the appliance, or that the owner, landlord or property manager has authorized you to request and approve the work and to give us access. If you are a tenant, getting any approval your lease requires is your responsibility.
2.3 Booking for someone else. If you book for a company, landlord or property manager, you confirm that you have authority to do so, and that organization is responsible for payment. If you book for another individual, you are responsible for payment unless that person or we agree otherwise in writing. A tenant or other occupant who only provides access is not responsible for payment unless they request or approve work themselves.
2.4 Accurate information. Give us accurate information, including your name, phone number, service address, the appliance type and brand, a description of the problem, and any hazards you know about. We rely on this information. If it is inaccurate, the visit may need to be rescheduled, and the diagnostic fee may apply as described in Section 4.4.
3. Using our website
3.1 Information only. Content on the Site, including articles, error-code pages, troubleshooting tips, pricing information and repair-or-replace guidance, is general information. It is not a diagnosis of your appliance, and it may not apply to your model. Manufacturer documentation for your model controls.
3.2 Do-it-yourself work is at your own risk. Appliances involve electricity, gas, water, sharp edges, heavy parts and stored electrical energy. If you inspect or repair an appliance yourself based on information on the Site, you do so at your own risk, and Swift is not responsible for the outcome. Always disconnect power, gas and water first and follow the manufacturer’s safety instructions. If you smell gas, leave the building immediately and call your gas utility or 911 from a safe place.
3.3 Prices on the Site are not quotes. Diagnostic fees, average costs, price ranges and other prices shown on the Site are for typical jobs, can differ by area and appliance, and can change without notice. Your price is the diagnostic fee shown when you book and the repair price in the written estimate you approve. We may correct errors in prices or descriptions at any time. If a correction changes a fee you were shown when you booked, we will tell you before the visit, and you may cancel without charge.
3.4 Service-area and booking tools. The ZIP code finder shows whether we usually serve an area. It does not guarantee that a technician is available. Time slots shown online are offered subject to confirmation, and we may need to reschedule as described in Section 4.
3.5 Third-party services. Our online booking, customer accounts, estimates, invoices, payments and many of our messages run on Housecall Pro, our field service management platform. Maps are provided by Google, and reviews appear on platforms such as Google, Yelp and Thumbtack. Your use of those services is also governed by their own terms and privacy policies. We are not responsible for the availability, content or practices of third-party websites or services, and a link to a third-party site is not an endorsement.
3.6 Availability. We may change, suspend or remove any part of the Site at any time. We do not promise that the Site will be available without interruption or free of errors.
3.7 Prohibited conduct. You may not:
- use the Site for any unlawful purpose or in violation of these Terms;
- submit false bookings or questions, or submit another person’s contact information without that person’s permission;
- send spam, malicious code or automated submissions through any form;
- probe, scan or test the Site for vulnerabilities, or bypass or interfere with security, bot protection, rate limits or access controls;
- overload or disrupt the Site or the systems behind it;
- access the Site by automated means, except as allowed in Section 18.5;
- impersonate Swift, our staff or any other person; or
- harass, threaten or abuse our staff or technicians through the Site or any other channel.
We may block or limit access to the Site for anyone who breaks these rules.
4. Appointments and scheduling
4.1 Arrival windows. We give you an arrival window, not an exact time. Earlier jobs can take longer than planned, and traffic, weather and parts pickups can cause delays. We try to let you know about delays, but we are not responsible for costs you incur because a technician arrives later than expected or a visit is rescheduled, such as time off work.
4.2 Arrival windows and booking. Visits are scheduled in the 2-hour arrival windows shown on the booking page. You can send a booking request at any time, and it is confirmed according to availability.
4.3 Our right to reschedule or cancel. We may reschedule or cancel a visit because of weather, emergencies, illness, vehicle problems, safety concerns or parts availability, or if the job turns out to be outside our scope or service area. If we cancel or reschedule before the technician arrives, you owe nothing for that visit, and our only obligation is to reschedule it or cancel it without charge. If the technician has already arrived, Sections 5.3 and 10.5 apply.
4.4 Your cancellations and missed visits. Please cancel or reschedule as early as possible, using your confirmation message, your customer account, or by calling or texting us. If you cancel after we have sent you the technician’s on-the-way notice, or if the technician arrives during the arrival window and cannot get access to the appliance or no authorized adult is present (Section 5), we may charge the diagnostic fee shown at booking as a trip charge for the missed visit.
4.5 Return visits. Many repairs need a second visit to install parts we ordered. We schedule the return visit after the parts arrive, and it is charged as stated in your estimate. If parts are waiting for you and you do not schedule installation, Section 8.6 applies.
5. Your responsibilities at the visit
5.1 Before and during the visit, you agree to:
- have an adult (18 or older) who can approve estimates and payment present for the whole visit, or, for jobs booked by a landlord, property manager or home warranty company, an adult who can give access;
- give us safe, clear access to the appliance and enough room to work, including access to water shut-off valves, outlets, the electrical panel and gas shut-off valves;
- empty the appliance where needed (for example, food from a refrigerator, dishes from a dishwasher, laundry from a washer or dryer); our technicians do not move furniture or other heavy items;
- keep pets secured and children away from the work area;
- have power, water and gas available as needed for testing;
- give us gate codes, parking instructions and other access information in advance; and
- tell us before the visit about any known hazards, such as a gas smell, active leaks, electrical problems, mold, pests or anything else that could affect safety.
5.2 Manufacturer warranties. If your appliance is still covered by the manufacturer’s warranty, the manufacturer may require repairs to be done by its own authorized servicer, and work by an independent company may affect that coverage. Tell us before the visit if your appliance is under a manufacturer’s warranty. Swift is an independent service company and is not an authorized servicer for any manufacturer unless a page on the Site or your estimate says otherwise.
5.3 Our right to decline or stop work. We may decline to start or may stop work and leave if conditions are unsafe or unsanitary, including signs of insect or rodent infestation in or around the appliance, mold, sewage, hazardous materials, unsafe electrical or gas conditions, clutter that prevents safe access, or aggressive animals. We may also leave if anyone at the property is abusive, threatening, harassing or discriminatory toward our staff. In these cases, the diagnostic fee and any work already performed may be charged. We may also decline to take an infested appliance or part into our vehicle.
6. Diagnostic fee, estimates and your approval
6.1 Diagnostic fee. The diagnostic fee covers the trip and the technician’s time to inspect and test one appliance and identify the likely cause of the problem. The amount is shown when you book and on your area page, and it depends on the type of appliance and the area. The fee is charged per appliance. If we look at more than one appliance during a visit, each appliance has its own diagnostic fee.
6.2 When the fee is credited. If you approve the repair we recommend for an appliance within the estimate’s validity period and we perform it, the diagnostic fee for that appliance is credited toward the repair price. The diagnostic fee is due, and is not credited, if you decline the repair, if no repair is needed (for example, no fault is found or the problem is a setting or installation issue), if the appliance cannot be repaired or the repair is not economical, if needed parts are unavailable or discontinued, or if you do not schedule the repair.
6.3 What a diagnosis is. A diagnosis is a professional opinion based on the symptoms, tests and inspection at the time of the visit. Some faults are intermittent or hidden and can only be confirmed after further disassembly or after a part is replaced. An appliance can also have more than one fault. If a further problem appears during or after a repair, we will explain what we found, and any additional parts or labor require a new or revised estimate and your approval. A separate fault is not a warranty matter under Section 9.
6.4 Written estimate before any repair. Before we repair anything, you receive a written estimate that describes the work and the price for parts and labor, plus applicable tax. The estimate may be delivered through your customer account, by text or email, or on the technician’s device. Work starts only after you approve the estimate, by electronic signature, by approving it in your customer account, by written confirmation by text or email, or, if you are present, by verbal approval that the technician records in the work order.
6.5 Changes in scope or price. If we find additional problems during the work, or if the cost would exceed the amount you approved, we stop and ask you before going further. We do not charge more than the approved amount for the approved work without your approval, except for applicable tax and changes you request.
6.6 Estimate validity. Estimates are valid for 30 days unless the estimate says otherwise, because parts prices and availability change. After that, we may need to update the estimate.
6.7 Repair or replace. When a repair would cost more than about half the price of a comparable new appliance, we tell you so that you can decide whether the repair is worth it. The decision is yours. Our opinion about an appliance’s condition is not a guarantee of how long the appliance will last.
7. Payment
7.1 When payment is due. Payment is due when each visit is completed, including diagnostic visits, unless we have agreed in writing to other terms (for example, invoice terms for an approved landlord, property manager or business customer).
7.2 Payment methods. We accept the payment methods listed on your area page and invoice. Card payments are processed by the payment processor integrated with our field service platform. We do not store your full card number.
7.3 Taxes. Prices do not include sales tax. In North Carolina and many other states, repair, maintenance and installation services and the parts used are subject to sales tax, which we add as required by law.
7.4 Late payment. If a balance is not paid when due, we may suspend further service and warranty work until it is paid, and we may charge interest from the due date at the legal rate (currently 8% per year in North Carolina). If we refer an unpaid balance to an attorney for collection, you will owe reasonable attorneys’ fees only to the extent allowed by N.C.G.S. § 6-21.2 or other applicable law, after any written notice the law requires.
7.5 Returned payments. If a check or electronic payment is returned unpaid, we may charge the processing fee allowed by law (in North Carolina, currently up to $35) in addition to the unpaid amount.
7.6 Card disputes. If you have a problem with a charge, please contact us first so we can resolve it. If you dispute a charge for work you approved and received, we will provide your card issuer with the approved estimate, your approval or signature, photos and service records. An unwarranted dispute does not cancel the amount you owe.
7.7 Home warranty, insurance and other third-party payers. Unless we agree in writing to bill a third party directly, you pay us in full. We will provide invoices and diagnostic information to support your claim. Whether your home warranty company, insurer or another party reimburses you is between you and them. We are not a party to your contract with them and do not guarantee coverage or approval.
7.8 Financing. If we offer consumer financing through a third-party lender, the lender’s terms govern that financing. Swift is not the lender.
7.9 Right to cancel certain home sales. Repairs you asked us to come out for are not covered by home-sale cancellation rules. If you buy other goods or services from us during a visit to your home and the sale is covered by the Federal Trade Commission’s Cooling-Off Rule or a similar state law, you may cancel that sale within three business days, and we will give you the notice and cancellation form the law requires.
8. Parts
8.1 Part quality. We use original manufacturer (OEM) parts when they are available from our suppliers. If an OEM part is unavailable, discontinued or significantly delayed, we tell you and, only with your approval, may use a quality aftermarket or compatible part. Your estimate will show this.
8.2 Ordering and deposits. Parts we do not carry are ordered from suppliers. Special-order, high-cost and non-returnable parts are paid for in advance, before we place the order. Your estimate shows whether a part is returnable.
8.3 Delays and availability. Delivery times given by suppliers and manufacturers are estimates. We are not responsible for supplier or manufacturer delays, backorders or discontinued parts. If a part you prepaid cannot be obtained, we refund the amount you paid for that part.
8.4 Cancelling after parts are ordered. If you cancel a repair after parts are ordered, we refund amounts paid for returnable parts, less any restocking or return-shipping fees charged by the supplier. Special-order and non-returnable parts are not refundable once ordered, and we will give them to you on request.
8.5 Parts you supply. We may decline to install parts we did not supply. If we agree to install a part you supply, there is no warranty on that part, our labor warranty does not cover failures caused by that part, and diagnostic and labor charges apply whether or not the part solves the problem. An extra visit needed because the part is wrong or defective is charged.
8.6 Unclaimed parts. If parts ordered for your repair arrive and you do not schedule installation or respond within 30 days after we notify you, we may return the parts to the supplier and refund what you paid for them, less any restocking or return-shipping fees the supplier charges. Non-returnable parts will be held for pickup or delivery for another 30 days. After that, and after at least 14 days’ written notice to you, they are treated as abandoned and may be disposed of, to the extent permitted by law.
8.7 Removed parts. Unless you ask to keep them before work begins, parts we remove become our property for disposal, recycling or return to the supplier or manufacturer. Some parts replaced under a manufacturer’s or supplier’s warranty must be returned and cannot be left with you.
8.8 Items in our possession. If we take an appliance or component to repair it away from your property, you must pick it up (or let us deliver it) and pay the balance within 30 days after we notify you that the work is complete or that the item will not be repaired. After that, we may exercise any lien rights available under applicable law, including North Carolina General Statutes Chapter 44A, Article 1, and, after any notice the law requires, sell or dispose of the item.
9. Limited labor warranty
9.1 What is covered. For 90 days from the date a repair is completed, if the repair fails because of a defect in our workmanship, we will return and correct it at no labor charge (the “Labor Warranty”). The Labor Warranty covers the specific repair listed on your invoice, on the same appliance at the same address, and applies once the invoice is paid in full.
9.2 Parts. Parts are covered by the warranty of their manufacturer or supplier, and periods and conditions vary by part and supplier. Ask us for the terms that apply to your part. If a part we supplied fails within our 90-day Labor Warranty period, the labor to replace it is free; the replacement part is charged unless the manufacturer or supplier provides it under its own warranty. After the 90 days, both labor and the part are charged.
9.3 What is not covered. The Labor Warranty does not cover:
- a different failure or component, even in the same appliance;
- normal wear, misuse, abuse, neglect, accidents or use other than the manufacturer intended;
- power surges, lightning, voltage problems, flooding, fire, pests or other events outside our control;
- problems with the home’s water supply, drains, venting, gas supply or electrical system;
- cosmetic damage, or consumable items such as filters and light bulbs;
- parts you supplied;
- failures caused by moving, reinstalling or servicing the appliance by anyone other than Swift after our repair;
- a partial or temporary repair you chose instead of the repair we recommended, with respect to failures related to it;
- failures caused by not following our written recommendations, such as having a dryer vent cleaned; or
- diagnostic-only visits, and cleaning or maintenance services (which improve condition but do not guarantee future performance).
9.4 How to make a warranty claim. Contact Swift Appliance Repair LLC within the warranty period: by phone at (888) 800-8094 or your area’s local number, by email at [email protected], through your customer account, or by mail to 5035 Tura St, Raleigh, NC 27610. Describe the problem, and give us a reasonable opportunity to inspect and fix it. Do not have another company work on the appliance first. We do not reimburse another company’s charges unless we agree in writing in advance. If we find that the problem is not covered, a diagnostic fee may apply to the visit.
9.5 Your remedy. Under the Labor Warranty, we will, at our option, redo the failed repair or refund the labor charge for it. To the extent permitted by law, this is your exclusive remedy for warranty claims.
9.6 Implied warranties. To the extent permitted by law, any implied warranties for our Services and for parts we supply, including implied warranties of merchantability, fitness for a particular purpose and workmanlike performance, are limited in duration to 90 days from the date the work is completed.
Some states do not allow limits on how long an implied warranty lasts, so this limit may not apply to you.
9.7 Incidental and consequential damages. Under this warranty, Swift is not responsible for incidental or consequential damages, such as spoiled food, water damage from plumbing we did not install, laundromat or meal costs, or time off work. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. This warranty gives you specific legal rights, and you may also have other rights that vary from state to state.
9.8 No manufacturer affiliation. Our work does not extend or replace any manufacturer’s warranty, and we do not act on behalf of any manufacturer.
10. Installation services
10.1 Scope. Unless your estimate says otherwise, installation means placing an appliance that is already at your property, connecting it to existing utility connections at the installation location (outlet, water supply valve, drain, gas shut-off valve and connector, or exhaust vent), leveling it and checking that it operates.
10.2 Your responsibilities. Before the visit, confirm that the appliance fits the space, cut-out and clearances, and that your electrical, water, drain, gas and venting connections match the manufacturer’s requirements, comply with applicable codes and are in working order. Inspect the appliance for delivery damage. We are not responsible for defects or damage that existed before installation.
10.3 Not included unless stated in your estimate. Cabinet, countertop, flooring or wall modifications; new or altered electrical circuits or outlets; new or altered water supply or drain lines; gas piping or new venting; permits; and haul-away or disposal of old appliances. Work that applicable law allows only a licensed electrical, plumbing, mechanical (HVAC) or fuel-gas contractor to perform is not part of our appliance installation services.
10.4 Installation materials. New hoses, power cords, connectors and vent materials required or recommended by the manufacturer may be added to your estimate. If you ask us to reuse old hoses, cords or connectors, you accept the risk of their failure.
10.5 Our right to decline. We may decline to install an appliance if the connections or conditions are unsafe or do not comply with the manufacturer’s requirements, or if the appliance is damaged. In that case, a trip or diagnostic fee may apply.
10.6 Installation warranty. The Labor Warranty in Section 9 applies to our installation workmanship, including leaks at connections we made, for 90 days after installation. It does not cover the appliance itself, which is covered by its manufacturer’s warranty, or existing connections we did not install.
11. Pre-existing conditions and specific risks
11.1 Pre-existing conditions. We are not responsible for conditions that existed before our work or that we could not reasonably see, such as hidden leaks, corrosion, rot, mold, damage behind or under the appliance, worn components, or earlier improper installation or repairs.
11.2 Moving appliances. Many repairs require pulling an appliance out or removing it from cabinetry. We use reasonable care. We are not responsible for damage that results from carefully moving an appliance when the flooring, cabinetry, countertop, trim or wall is already damaged, weak, fragile or improperly installed (for example, loose tiles, vinyl flooring that tears, or built-in trim fitted without clearance), or when the space does not allow removal without damage. If we see such a risk, we will point it out before moving the appliance.
11.3 Plumbing and water. Old shut-off valves, supply lines, drain lines and fittings can fail when they are turned or disturbed. We are not responsible for failures of existing plumbing components we did not install, including valves that will not close or that break when operated. After any water-related repair, check the area for leaks over the next 48 hours. If you see a leak, shut off the water and contact us right away.
11.4 Food and contents. We are not responsible for spoiled food, medication or other contents lost because a refrigerator or freezer failed or was out of service, before, during or after our work. Please remove or protect perishable items.
11.5 Electrical and gas. Your home must have properly grounded outlets, correct circuits, working breakers, and a proper gas supply with a working shut-off valve. We may decline to work in unsafe conditions. We do not repair gas leaks in a home’s gas piping.
11.6 Dryer vents. Our dryer services cover the dryer itself. We do not clean dryer vent (exhaust) ducts that run through walls, roofs, attics or crawl spaces. Clogged, crushed or overly long vents cause overheating, poor drying and fire risk. We recommend regular vent inspection and cleaning by a vent specialist, and we are not responsible for damage caused by vent conditions.
11.7 Older appliances and fragile parts. An older appliance may have several worn components. Repairing one does not make the appliance new, and other parts may fail later. Old plastic clips, panels and trim can become brittle and may crack during normal disassembly. If that happens, we will tell you, and a replacement part may be an added cost.
11.8 Smart appliances. Repairs can reset settings, programs and Wi-Fi connections. Reconnecting apps and accounts is your responsibility.
12. Damage claims
12.1 Tell us promptly. If you believe our work damaged your property, notify us in writing (by email, text or your customer account) as soon as reasonably possible and no later than 72 hours after the visit, or after you discover the damage if it could not reasonably have been discovered earlier. Include photos.
12.2 Let us inspect. Give us a reasonable opportunity to inspect the damage before it is repaired. Please take emergency steps to stop a leak or prevent further damage; we will not hold those steps against your claim.
12.3 How we resolve claims. We investigate every claim. If we are responsible, we will, at our option, arrange the repair or pay the lesser of the reasonable cost to repair the damaged property or its actual cash value, subject to Section 21. Claims may be handled through our or our technician’s insurance carrier, and you agree to cooperate with the insurer’s reasonable requests.
12.4 Late notice. If late notice or repairs made before our inspection prevent us from investigating, your recovery may be reduced or barred to the extent permitted by law.
13. Our technicians
13.1 Who performs the work. Services are performed by technicians who may be Swift employees or independent contractor technicians, and their companies, working under agreements with Swift. In either case, your agreement for the Services is with Swift, and Swift is responsible to you for the Services as described in these Terms. We personally vet our technicians, including their work history and references, and require them to carry liability insurance. The technician assigned to your job may change.
13.2 No side deals. Our technicians may not accept payment outside Swift’s invoice or offer to do work for Swift customers on the side. Work arranged or paid for directly with a technician outside Swift’s booking and invoicing is not a Swift Service. It is not covered by these Terms, our warranty or our insurance, and Swift is not responsible for it. Please tell us if anyone asks you to pay for Swift work outside our invoice. If you are a business customer (for example, a landlord, property management company or commercial customer), for 12 months after a Service you also agree not to hire a technician you were introduced to through Swift, directly or through another company, for appliance work you would otherwise book through Swift, without our written consent.
14. Calls, texts and emails
14.1 Service communications. When you give us your phone number or email address (for example, to book, request an estimate, ask a question or receive Services), you agree that Swift and our service providers, including Housecall Pro, may contact you at that number or address by phone call, text message (SMS/MMS) and email, including through automated technology, about your request and our Services. These messages include booking confirmations, reminders, technician on-the-way and arrival notices, technician details, estimates, invoices, payment links and receipts, parts updates, warranty follow-ups, requests for feedback or reviews, and account notices. These are not marketing messages.
14.2 Marketing messages. We send promotional text messages only if you separately agree to receive them, for example by checking an unchecked box on a form or by texting YES in reply to our request for consent. Agreeing to promotional texts is never a condition of buying anything from us. We may send promotional emails to customers, and every promotional email includes an unsubscribe link.
14.3 Calls, recordings and automated assistant. Calls to our phone numbers may be answered by an automated (AI) phone assistant, especially when no one is available to answer in person. The assistant can answer questions and book appointments. Calls may be recorded and transcribed for quality, training, scheduling accuracy and dispute resolution. By continuing a call, you consent to this. If you do not want your call recorded, please hang up and contact us by email or through your customer account. The automated assistant can make mistakes. Prices, availability and policy information it gives you are confirmed in your booking confirmation and written estimate. If they differ from what the assistant told you, we will tell you before the visit, and you may cancel without charge.
14.4 Your phone number. You confirm that you are the subscriber or regular user of any phone number you give us, or that you have that person’s permission. If you are a landlord or property manager and give us a tenant’s number, you confirm that the tenant agreed to be contacted about the service. Tell us if your number changes or you no longer use it.
14.5 Opting out. You can stop text messages by replying STOP, unsubscribe from emails with the link in the email, or tell us by any reasonable means that you no longer want to be contacted. We honor opt-out requests within the time required by law.
15. Text message (SMS) terms
15.1 Program. Swift Appliance Repair sends text messages about appointments and Services, replies to questions you send us (for example, through the “Ask” form on an area page or by text), and, only if you opted in, promotional messages such as special offers and seasonal maintenance reminders.
15.2 Frequency and cost. Message frequency varies with your service activity. Message and data rates may apply.
15.3 How to stop. Reply STOP to any message to stop receiving texts from that number (STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, REVOKE and OPT OUT also work, as does any other reasonable request such as “stop texting me”). You will receive one message confirming the opt-out and no further texts from that number, including appointment updates, unless you opt in again by replying START. A member of our team may call or email you about service you have already scheduled. If you only want to stop promotional texts, tell us, and we will keep sending texts about Services you have booked.
15.4 Help. Reply HELP for help, or contact us at [email protected] or (888) 800-8094.
15.5 Other terms. Wireless carriers are not liable for delayed or undelivered messages. Consent to promotional texts is not a condition of purchase. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes, and text messaging opt-in data and consent will not be shared with any third parties, excluding service providers (such as our messaging platform and wireless carriers) that deliver messages on our behalf. See the text messaging section of our Privacy Policy.
16. Customer accounts
We provide an online customer account, hosted by our field service platform, where you can see estimates, invoices and messages. Access links sent to you by text or email may open your account without a password, so do not forward them. You are responsible for activity in your account and should tell us promptly about any unauthorized access. Account availability depends on our platform provider.
17. Reviews, feedback and photos
17.1 Honest reviews are welcome. We welcome honest reviews, positive or negative. We do not offer rewards for positive reviews, and nothing in these Terms limits your right to post an honest review of our Services. Nothing in these Terms, including Sections 18 and 22, restricts or penalizes any review or other communication protected by the Consumer Review Fairness Act (15 U.S.C. § 45b).
17.2 Reviews shown on the Site. Reviews on the Site are a selection chosen by us from reviews posted on Google, Yelp, Thumbtack and other platforms or sent to us. They are not a representative sample. To see all reviews, visit our profiles on those platforms. We may shorten a review for length without changing its meaning. Ratings and review counts on the Site reflect the platform figures as of our last update and may differ from current figures.
17.3 Feedback. If you send us suggestions or ideas, we may use them without obligation to you.
17.4 Job photos and records. Our technicians may take photos and videos of the appliance, model and serial plates, parts, the work area and completed work for diagnosis, parts ordering, quality control, warranty and supplier claims, your service record and dispute resolution. We may also use photos of appliances, parts and completed work, but not of people, on the Site, in our portfolio and in our marketing, after removing details that identify you or your home, such as your name, house number, street address, faces, family photos, documents and location data embedded in the photo files. A portfolio entry may name the city or area where the work was done. If you do not want photos from your job used in marketing, tell us at any time, and we will stop using them in new materials and remove them from the Site within a reasonable time.
17.5 Content you send us. You give us permission to use photos, videos and descriptions you send us to provide the Services and as part of your service records.
18. Intellectual property and copying
18.1 Our content. All content on the Site and in our materials, including text, articles, service and area pages, error-code pages and descriptions, FAQs, price tables, checklists, graphics, logos, icons, photographs, videos, portfolio cases, technician and team profiles, review compilations, page designs, layouts, the user interface, the look and feel, HTML, CSS and JavaScript code, data, and the selection, coordination and arrangement of all of it (together, “Site Content”), is owned by Swift or its licensors. Site Content is protected by United States and international copyright, trademark, trade dress, unfair competition and other laws. © Swift Appliance Repair LLC. All rights reserved.
18.2 Our trademarks. “Swift Appliance Repair,” “SwiftyPros,” our logos and our slogans are trademarks of Swift, whether or not registered. You may not use them, or any confusingly similar name, logo, domain name, social media handle, business listing or advertising text, without our written permission. You may refer to Swift by name accurately, for example in a news article or a review.
18.3 Manufacturer names. Swift is an independent service company. We are not affiliated with, endorsed by or sponsored by any appliance manufacturer, and we are not an authorized service center for any brand unless a specific page or your estimate says so. Brand names and logos on the Site belong to their owners and are used only to identify the appliances we service.
18.4 Your limited license. We give you a limited, revocable, non-transferable license to view the Site and to print or save a reasonable number of pages for your own personal, non-commercial reference about our Services. All other rights are reserved.
18.5 Search engines and AI assistants. Operators of general-purpose search engines and AI assistants may crawl, index and cache the Site, and may show snippets, short quotations and summaries of Site Content in response to their users’ questions, as long as they follow our robots.txt file and other machine-readable instructions, do not misrepresent Site Content or Swift, and, where practical, attribute and link to the Site. Any other automated access, including bulk downloading or using Site Content to build datasets or to train or fine-tune AI models, is permitted only to the extent our robots.txt file expressly allows it, and always subject to these Terms.
18.6 Linking. You may link to any page of the Site with an accurate, plain link, as long as you do not frame the page, suggest that we endorse you, or link from a site that is unlawful or misleading. We may withdraw this permission for any site.
18.7 What you may not do. Without our prior written permission, you may not:
- copy, reproduce, republish, upload, post, transmit, distribute, publicly display, sell or license any Site Content, in whole or in part, on any website, social media account, marketplace or business listing, advertisement, document or other medium;
- create derivative works from Site Content for any other business or website, including by rewriting, paraphrasing, translating or “spinning” it, or by using automated or AI tools to produce text, images or pages based on it;
- use our photographs, portfolio cases, videos, team or technician photos and profiles, or customer reviews as your own or to promote any other business;
- copy or imitate the design, layout, structure, look and feel, page templates or code of the Site in a way that is likely to cause confusion or to suggest that another business is Swift or connected with Swift;
- scrape, crawl, spider, harvest or extract Site Content or data, such as prices, reviews, service areas, ZIP codes, error codes or team information, by automated means, except as allowed in Section 18.5;
- use Site Content to train, fine-tune, prompt or ground an AI system in order to create content for, or compete with, another appliance service business;
- frame, mirror or proxy the Site, or hotlink to images or files on the Site from another website;
- remove, alter or obscure copyright notices, watermarks, image metadata or other copyright management information;
- register or use domain names, social media handles, business listings, advertising accounts or advertising text that contain our trademarks or confusingly similar terms, or otherwise present yourself as Swift, a Swift technician or a Swift partner;
- copy reviews that other people wrote about Swift and present them as reviews of you or another business;
- bypass rate limits, bot protection or other technical measures that protect the Site; or
- use the Site to collect personal information about our customers, staff or technicians.
18.8 Enforcement. We monitor for copying and enforce our rights. Unauthorized use may lead to: takedown notices to hosting providers, search engines, social networks and advertising platforms under the Digital Millennium Copyright Act (17 U.S.C. § 512); claims for actual damages and profits or, for works registered with the U.S. Copyright Office, statutory damages of up to $150,000 per work for willful infringement plus attorneys’ fees (17 U.S.C. §§ 504–505 and 412); separate statutory damages of $2,500 to $25,000 per violation for removing or falsifying copyright management information (17 U.S.C. §§ 1202–1203); trademark and unfair competition claims under the Lanham Act (15 U.S.C. § 1125); claims under the North Carolina Unfair and Deceptive Trade Practices Act (N.C.G.S. § 75-1.1), which allows treble damages and attorneys’ fees (N.C.G.S. §§ 75-16 and 75-16.1); and court orders stopping the use.
18.9 Commercial license and fees. Any commercial use of Site Content requires a written license from Swift. Our standard license fees are $1,000 for each page or article (or substantial part of one) and $500 for each photograph, video or graphic, for each 12-month period, or part of one, during which the content is used. If anyone uses Site Content commercially without a license, we may invoice our standard license fee for that use and seek it, or any other remedy available by law, including actual or statutory damages. This Section does not limit our right to seek a court order stopping the use.
18.10 Court orders. You agree that a breach of this Section 18 would cause Swift irreparable harm for which money damages alone are not an adequate remedy, and that Swift may seek an injunction or other equitable relief in any court with jurisdiction, without first going through the process in Section 23.
18.11 Report copying. If you see our content, photos or name used somewhere else, please tell us at [email protected] with the subject line “Copyright.”
18.12 Copyright complaints about the Site. If you believe something on the Site infringes your copyright, send a notice to the same address. Include your contact information, the work you believe was infringed, the location of the material on the Site, a statement that you have a good-faith belief that the use is not authorized, a statement under penalty of perjury that the information in your notice is accurate and that you are the owner or authorized to act for the owner, and your physical or electronic signature. We will review the notice and remove material where appropriate.
19. Privacy
Our Privacy Policy explains how we collect, use and share personal information, including through Housecall Pro and the other services we use.
20. Disclaimers
20.1 The Site. The Site and Site Content are provided “as is” and “as available.” To the fullest extent permitted by law, Swift disclaims all warranties regarding the Site and Site Content, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose and non-infringement.
20.2 The Services. Except for the warranties in Sections 9 and 10.6 and any implied warranties that cannot be disclaimed (limited as stated in Section 9.6), we make no other warranties for the Services. We do not promise that every appliance can be repaired, that parts will be available, or that a repaired appliance will not develop other problems.
21. Limitation of liability
21.1 Excluded damages. To the fullest extent permitted by law, Swift and its members, employees, technicians, contractors and agents are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of food or other contents, loss of use of an appliance, laundromat, meal or hotel costs, lost wages or time away from work, lost profits, or lost data, arising out of or related to the Site or the Services, even if we were told such damages were possible.
21.2 Cap. To the fullest extent permitted by law, Swift’s total liability for all claims relating to a Service is limited to the greater of (a) the amount you paid Swift for that Service, or (b) for physical damage to property proved to have been caused by our negligence, the lesser of the reasonable cost to repair the damaged property or its actual cash value. For claims relating only to the Site, Swift’s total liability is limited to $100.
21.3 What is not limited. Nothing in these Terms limits liability for death or bodily injury caused by our negligence, for our gross negligence, willful misconduct or fraud, or for any other liability that cannot be limited under applicable law. Some states do not allow the exclusion or limitation of incidental or consequential damages, so some of these limits may not apply to you.
21.4 Allocation of risk. Our prices reflect the allocation of risk in these Terms.
22. Indemnification
To the extent permitted by law, you agree to defend, indemnify and hold harmless Swift and its members, employees, technicians, contractors and agents from third-party claims, losses and expenses (including reasonable attorneys’ fees) arising from: (a) your breach of these Terms, including any misuse of Site Content under Section 18 or prohibited conduct under Section 3.7; (b) any false statement that you own the property or appliance or are authorized to approve the work; or (c) your violation of any law or third-party right. You are not required to indemnify anyone for injury, death or property damage caused in whole or in part by the negligence or misconduct of Swift or its members, employees, technicians, contractors or agents. We may control the defense of any claim covered by this Section, and you agree to cooperate.
23. Dispute resolution and arbitration
23.1 Talk to us first. Most concerns can be resolved quickly. Before starting arbitration or a court case, the party with the claim must send the other a written notice describing the claim and the relief requested, with the claimant’s name, phone number and service address. Notices to Swift go to [email protected] (subject line “Legal Notice”) or to our mailing address in Section 27. If the claim is not resolved within 30 days after the notice is received, either party may proceed. Any deadline to bring the claim is paused during those 30 days.
23.2 Agreement to arbitrate. Except as provided in Section 23.3, you and Swift agree that any dispute, claim or controversy arising out of or relating to these Terms, the Site, the Services, our communications with you (including calls and text messages and any claim under the Telephone Consumer Protection Act or a similar state law), or any other aspect of the relationship between you and Swift, whether based on contract, tort, statute, fraud, misrepresentation or any other legal theory, and whether it arose before or after you accepted these Terms, will be resolved by final and binding arbitration on an individual basis, not in court. The arbitrator, and not a court, decides all questions about the scope, interpretation, applicability and enforceability of this agreement to arbitrate, except that a court decides questions under Sections 23.5 and 23.6.
23.3 Exceptions. Either party may: (a) bring an individual claim in small claims court if it qualifies and stays there on an individual basis; (b) seek an injunction or other equitable relief in court to protect intellectual property (Section 18) or to stop unauthorized access to or abuse of the Site; and (c) bring any claim that applicable law does not allow to be arbitrated in the court described in Section 24.
23.4 Rules and procedure. The Federal Arbitration Act governs this Section 23. The arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, or its Commercial Arbitration Rules if you obtained the Services for business purposes, as modified by this Section. The rules are available at adr.org. If the AAA is unavailable, the parties will agree on another administrator, or a court will appoint one. Payment of filing, administration and arbitrator fees is governed by the applicable AAA rules, and Swift will pay the fees those rules require a business to pay. For claims under $25,000, the arbitration will be decided on written submissions or by video conference unless the arbitrator requires an in-person hearing. Any in-person hearing will take place in the county where the Services were performed, or in Wake County, North Carolina if no Services were involved. The arbitrator may award any individual relief that a court could award and will issue a written decision. Judgment on the award may be entered in any court with jurisdiction.
23.5 Class action waiver. You and Swift may bring claims against each other only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. The arbitrator may not consolidate the claims of more than one person or preside over any form of class or representative proceeding. If a court finds this waiver unenforceable for a particular claim or request for relief, that claim or request (and only that one) will be severed and decided in the court described in Section 24, after all individual claims have been arbitrated. This Section never permits class arbitration.
23.6 Mass filings. If 25 or more similar arbitration demands are filed against Swift by or with the help of the same law firm or a coordinated group, the AAA’s supplementary rules for mass arbitrations will apply, and the demands may be administered in batches. Any deadline to bring a claim is paused for demands waiting to be administered.
23.7 No judge or jury. In arbitration there is no judge or jury, and court review of an arbitration award is limited.
23.8 Your right to opt out. You may opt out of this agreement to arbitrate by sending written notice within 30 days after you first book Services or approve an estimate under these Terms to [email protected] with the subject line “Arbitration Opt-Out,” or by mail to our address in Section 27. Include your name, service address, phone number and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.
23.9 Changes to this Section. If we change this Section 23 after you have accepted it, the change will not apply to any claim you had already notified us about. You may reject a change by sending us written notice within 30 days after it takes effect, in which case the earlier version of this Section continues to apply to you.
23.10 Survival. This Section 23 survives the end of your relationship with Swift.
24. Governing law and venue
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules, and by the Federal Arbitration Act. Subject to Section 23, any court action must be brought in the state or federal courts located in Wake County, North Carolina, and you and Swift consent to the personal jurisdiction of those courts, except where the law of the state where your property is located requires consumer claims to be heard in a different place.
25. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top shows when they last changed, and changes take effect when posted. For each job, the version in effect when you approved its estimate applies (for a diagnostic-only visit, the version in effect when you booked it). If you keep using the Site or booking Services after a change, you accept the updated Terms.
26. General terms
26.1 Entire agreement. These Terms and the estimates and invoices for your jobs are the entire agreement between you and Swift about their subject matter.
26.2 Severability. If any part of these Terms is found unenforceable, it will be enforced to the maximum extent permitted, and the rest of these Terms remain in effect.
26.3 No waiver. If we do not enforce a provision, that does not waive our right to enforce it later.
26.4 Assignment. You may not transfer your rights or obligations under these Terms without our consent. We may transfer ours, for example to an affiliate that operates your service area or in a sale or reorganization of our business.
26.5 Events beyond our control. We are not responsible for delays or failures caused by events beyond our reasonable control, such as severe weather, natural disasters, power or internet outages, supply-chain disruptions, government orders or public health emergencies.
26.6 Electronic records and signatures. You agree that we may provide these Terms, estimates, invoices, receipts and notices electronically, and that your electronic approvals and signatures are binding, as permitted by the federal E-SIGN Act and the North Carolina Uniform Electronic Transactions Act. You may ask us for a paper copy of any estimate or invoice.
26.7 Notices. We may send notices to the email address, phone number or mailing address we have on file for you. Legal notices to Swift must be sent as described in Section 23.1.
26.8 Survival. Sections that by their nature should continue after a job is completed or after you stop using the Site, including Sections 7, 8.6–8.8, 9, 12, 13.2, 17, 18 and 20–26, survive.
26.9 Interpretation. Headings are for convenience only. “Including” means “including without limitation.” If these Terms are translated, the English version controls.
